The Dundrum Heritage Group(DHG) are hoping that their efforts in the High Court will be successful in preventing the creation of an IPAS centre in the Dundrum House Hotel Complex. The group were granted permission yesterday to have their case for a Judicial Review of Tipperary Council’s decision to grant a Section Five Declaration to Brogan Capital Ventures heard by the court with a date for a full hearing now set for April 28th.
The Section Five represents the council’s decision that the change of use status from Hotel to IPAS accommodation centre does not require planning permission under the legislation as amended in 2022.
The group hopes that the impending hearing and the ongoing separate legal case between the US investors and the current hotel operator as to who holds beneficial ownership of the property will give the Government reason to pause issuing any contract.
The facility is deemed to have a capacity of 277 persons and the Section Five application does not include the original Manor Building which is a cause of concern for the DHG as they fear the building will deteriorate due to a lack of use and maintenance. The group are also concerned about the lack of planning permission for bedrooms that are included in the Section Five application and the sewage infrastructure on the site which it claims is not in compliance with the EU Habitats Directive.
