Pensioner Will Not Appeal Kelly Land Row Decision
Written by David Condon
Thursday, 02 January 2014 11:32
A woman who lost a bitter land dispute with a government minister has said she is disappointed by the court decision but will not be appealing.

Breaking her silence on the long-running row with junior public transport minister Alan Kelly, pensioner Diana Whitehead (72) said she was "just relieved" the case was over.

In November, a court found she did not have the right to access a lane owned by the Kelly family, and close to the minister's home, near Lough Derg.

However, a judge found against her after hearing evidence that the laneway had been owned by the Kellys since the 1930s. The Kellys indicated after the case that they would not be seeking their costs, which could amount to €40,000.

Mrs Whitehead told the Irish Independent she was "very glad" of this and now wanted to put the dispute behind her.
